The Hungarian government has appealed to the European Court of Justice against a decision regarding the use of frozen Russian assets to finance military aid to Ukraine, reports Portfolio. The lawsuit was filed against the Council of the European Union and the European Peace Facility in July. The court began its review on August 25, 2025.

Hungarian authorities are trying to challenge the decision made by the EU Council in May 2024, which created a legal basis for using frozen Russian assets to aid Ukraine. Specifically, this document provided for the transfer of almost all proceeds from the taxation of income from Russian assets to the European Peace Facility, from where expenses for military aid to Kyiv are compensated.

Budapest claims that this decision was made without considering Hungary’s position, which violates the coordination procedure.

Since the start of the full-scale Russian-Ukrainian war, more than 260 billion euros of Russian assets have been blocked in Western countries, with the majority of them (approximately 190 billion euros) held in the Belgian depository Euroclear.

Despite repeated discussions on the confiscation of frozen assets, EU countries feared possible consequences for the stability of the euro. As a result, the European Union decided to use the profits from frozen assets to aid Ukraine.

Russian authorities oppose the use of both the frozen assets themselves and the income from them by the West.
