The State Prosecutor's Office has asked the court to throw out the claim of 104 victims of the massacre at the Nova festival near Kibbutz Reim on October 7th. The victims of the attack and their loved ones have filed a huge lawsuit against the state, accusing the army, Shin Bet and police of criminal negligence, due to which dozens of people died. The lawsuit states that “on the night of October 6–7, a single call from the commander in charge of the Western Negev border region would have been enough to save dozens of people from death and hundreds of people from physical and mental injury.”
The state has put forward two reasons for refusal, both of which can only cause outrage. First, the response from the prosecutor's office states that all victims and families of those killed as a result of the Hamas attack receive large payments from Bituah Leumi as victims of terror, and therefore, if the case is closed, they will not be left without money.
And secondly, and this is the main thing, in the opinion of the state, the issue of responsibility of the army, the Shin Bet and the political leadership of the country for the events of October 7 is too large and deep to be considered in the district court as part of a claim for compensation.
“The reasons for making decisions on security issues remain closed to the public, so the court cannot make verdicts on these issues – it does not have the tools to evaluate the behavior of the authorities,” the prosecutor’s office argues.
